Privacy Policy

This information notice is intended to inform the user about the methods of processing their personal data.

This notice is provided to you – also pursuant to Article 13 of European Regulation 2016/679 on the protection of personal data (“Regulation” or “GDPR”) and Legislative Decree 30 / 06 / 2003 No. 196 (“Privacy Code”), as amended and supplemented by Legislative Decree 101/2018, and any subsequent amendments and additions – by SUDCAPSULE S.R.L., with registered office in Scafati (SA), Via S. Antonio Abate 10, in its capacity as Data Controller of your personal data.

The website offers informational and, at times, interactive content. While browsing the Sud Capsule site, information about the visitor may therefore be acquired in the following ways:

Browsing data

The computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes: IP addresses, the type of browser used, the operating system, the domain name and addresses of websites from which access was made, information on the pages visited by users within the site, the time of access, time spent on each page, internal path analysis and other parameters relating to the user’s operating system and IT environment.

Additional categories of data

This concerns all personal data provided by the visitor through the site, for example:

  • by filling in a form to request information about the services offered and/or a contact request;
  • by writing to the email addresses indicated on our site to request information;
  • by filling in a form to submit your curriculum vitae;
  • by filling in a form to receive our newsletter and marketing communications;
  • by filling in a form to register for one of Sud Capsule’s initiatives (conferences, seminars, workshops, events).

The data provided are processed for the following purposes:

  • to provide the information and/or service requested by the user, manage contracts finalized by the user, fulfil the related administrative, accounting, tax and legal obligations, and handle the requests submitted by the user. Processing for these purposes is necessary for the fulfilment of contractual obligations and does not require specific consent from the data subject;
  • to assess the user experience of our platforms, products and services and to ensure the correct functioning of the web pages and their contents. Processing for these purposes is based on the legitimate interest of the Data Controller;
  • to send commercial communications relating to promotions and/or offers, in the interest of the Data Controller; processing for these purposes is carried out with the specific consent provided by the user.

The data collected by Sud Capsule will be shared only for the purposes described above; we will not share or transfer your personal data to third parties other than those indicated in this Privacy Policy.

In the course of our activities and exclusively for the same purposes as those listed in this Privacy Policy, your personal data may be transferred to the following categories of recipients:

  • company personnel;
  • service providers (e.g. IT system providers, cloud service providers, database providers and consultants);
  • Public Authorities for legal purposes;
  • any public and/or private entity to which communication of your personal data becomes necessary in relation to the purposes indicated above.

The updated list of Data Processors is available at the Data Controller’s registered office and will be provided upon written request.

Sud Capsule may need to transfer your personal data to countries outside the European Union/European Economic Area (EEA), to so-called “third countries”. Such transfers to third countries may include all the processing activities mentioned above.

This Privacy Policy is also applicable in the case of data transfers to third countries where the level of data protection differs from that of the European Union: any transfer of personal data to third parties will be carried out only after informing you and, where required, after obtaining your consent. Any transfer of data to countries other than those for which the European Commission has issued an adequacy decision is carried out on the basis of agreements that use the standard contractual clauses adopted by the European Commission or other appropriate safeguards in compliance with applicable laws.

Sud Capsule has implemented appropriate technical and organizational measures to provide an adequate level of security and confidentiality for personal data.

These measures take into account:

  • the state of the art of technology;
  • implementation costs;
  • the nature of the data;
  • the risk of processing.

The aim is to protect them from accidental or unlawful destruction or alteration, accidental loss, disclosure or unauthorized access and from other unlawful forms of processing.

Furthermore, when managing your personal data, Sud Capsule:

  • collects and processes personal data that are adequate, relevant and not excessive, as required to fulfil the purposes outlined above; and
  • ensures that such personal data remain up-to-date and accurate.

Without prejudice to your right to object to the processing of personal data and/or to request their deletion, Sud Capsule will retain your personal data only for the time necessary to achieve the purpose for which they were collected and received, or to meet legal or regulatory requirements.

When this period expires, your personal data will be removed from Sud Capsule’s active systems.

The rights related to the personal data processed by Sud Capsule are:

  • Right to rectification. You may obtain the rectification of personal data concerning you that you have communicated to us. Sud Capsule makes reasonable efforts to ensure that the personal data in its possession are precise, complete, up-to-date and relevant, based on the most recent information available;
  • Right to restriction. You may obtain a restriction on the processing of your personal data if:
  • you contest the accuracy of your personal data for the period in which Sud Capsule must verify their accuracy;
  • the processing is unlawful and you request a restriction of processing or the deletion of your personal data;
  • Sud Capsule no longer needs to keep your personal data but you need them to establish, exercise or defend your rights in court; or
  • you object to the processing while Sud Capsule verifies whether its legitimate reasons prevail over yours.
  • Right of access. You may request information from Sud Capsule regarding the personal data held about you, including information on what categories of personal data Sud Capsule owns or controls, for what purpose they are used, where they were collected (if not directly from you), and to whom they may have been communicated;
  • Right to portability. Upon your request, Sud Capsule will transfer your personal data to another Data Controller, where technically feasible, provided that the processing is based on your consent or is necessary for the execution of a contract.
  • Right to erasure. You may obtain from Sud Capsule the deletion of your personal data if:
  • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • you have the right to object to further processing of your personal data and you exercise this right of objection;
  • the personal data have been processed unlawfully.

Unless the processing is necessary due to legal obligations or in order to establish, exercise or defend a right in court.

  • Right to object. You may object at any time to the processing of your personal data, provided that the processing is not based on your consent but on the legitimate interests of Sud Capsule or third parties. In such cases Sud Capsule will no longer process your personal data unless it can demonstrate compelling and legitimate reasons, an overriding interest in processing, or the establishment, exercise or defense of a right in court. If you object to the processing, please specify whether you intend to delete your personal data or limit their processing.
  • Right to lodge a complaint. In the event of an alleged violation of applicable privacy law, you may lodge a complaint with the competent authorities in your country or where the alleged violation occurred.

Any future changes or additions to the processing of personal data as described in this Privacy Policy will be notified through the usual communication channels used by Sud Capsule (for example by email or via the website).
